In this UKELA Podcast, Richard Kimblin KC is joined by the three editors of an insightful and comprehensive book which explores the dynamics which are driving courts across Europe in nature conservation: Mariolina Eliantonio, Emma Lees and Tiina Paloniitty.
It looks critically at how decision makers and courts understand and analyse scientific information by reference to the Habitats and Bird Directives - the core of both domestic and EU nature conservation law.
What influences judges in these cases; how do national procedural norms affect the approach and outcome; does the stated approach always correlate well with the actual result; how does the precautionary principle manifest itself in real world outcomes which restrict and freeze development decisions; does this feed into constitutional tensions as between the role of the court and the executive in some instances?
