This chapter we explore the complexities of handling debt in divorce within a community property state, with a particular focus on Texas law. We discuss the importance of the date of separation in distinguishing between communal and individual debt, the role of income and the concept of temporary spousal maintenance versus the challenges of obtaining spousal maintenance post-divorce. We also touch on the distribution of assets and how one's financial contribution during the marriage can impact the outcome. Additionally, I share insights on the value of prenuptial agreements and the significance of financial transparency and preparation for the eventual end of a marriage, whether by divorce or death. Lastly, I emphasize the importance of understanding all aspects of marital responsibilities, from bill payments to child-rearing, to better equip oneself for potential life after divorce.
